BERGER PAINT-TASTIC Christmas Promotion Rules

• The name of the promotion is “Berger PAINT-TASTIC Christmas”
• Entrants must be at least 18 years of age at the time of entry.
• Employees, directors (and their parents, siblings, spouses and children) of BERGER PAINTS and their respective advertising agencies and participating hardware stores are not eligible to participate in the Promotion.

How to Enter

• Shoppers will receive a "Peel & Win" ticket for every three (3) gallons of eligible Berger Paints purchased in participating hardware stores. Eligible products are Royale Emulsions, Weatherproof, 303, Everglow, 404, Rust Pro, Magicote Flat and Magicote Gloss, whether the purchase is in quarts, one gallon or 5-gallon pails.
• To enter for a chance to win the fortnightly or grand prize, entrants are required to:
  
  a. visit the website at www.bergerpaints.mobi, and enter the alphanumeric codefrom the peel & win ticket with their contact information (name, email address and telephone number).
  
  b. Entrants can also enter for the fortnightly or grand prize by sending a text message to the number 876-596-4369 on the Digicel network with the alphanumeric code from the peel & win ticket. Local SMS rates will apply.
• Winners must present proof of purchase and the winning peel and win ticket to claim prizes.
  
  The promotion runs from November 4th, 2018 until 11:59 PM EST December 31st, 2018. BERGER PAINTS is not responsible for late, incomplete, misdirected entries or printing errors. All entries received from ineligible entrants will be void. All entries become the property of the BERGER PAINTS.

The Prizes

• Peel and Win ticket prizes are: Discounts on paint redeemable in 2019 (10% off up to 5 gallons of any Berger paint, 15% off up to 5 gallons of any Berger paint and 25% off up to 3 gallons of any Berger paint), Baseball Caps, Tote Bags, Stylus Pens, Water Bottles, Key Rings LED Flashlights, Bottle Openers, Ear Buds, Car Chargers, Sun Visors and Umbrellas.
• Winners of Baseball Caps, Tote Bags, Stylus Pens, Water Bottles, Key Rings LED Flashlights, Bottle Openers, Ear Buds, Car Chargers, Sun Visors and Umbrellas will instantly receive their prizes at the store where they purchased the BERGER PAINT products. Winners of the 25%, 15% and 10% discounts have from January 2nd 2019 to March 31st 2019 to redeem their discount, these discounts cannot be combined with any other BERGER PAINT discount.
• The fortnightly prizes are Eight Aiwa 40” SMART TV Dimension without stand: (LXWXH) valued at $35,000 each. There will be eight fortnightly winners for the duration of the promotion (two each fortnight). The Grand Prize is a CHOICE of a 4 night Caribbean Cruise for two – departing from Miami (including airfare if required) or a 3 night stay at a Jamaican allinclusive resort for 2 persons. The prize will be valid for one year as of the day of the draw. Either grand prize has a maximum value of J$350,000, inclusive of all taxes and fees related to prize won. Winners of the grand prize will be solely responsible for all and any other related travel expenses incurred (i.e. transportation to and from the airport, to and from the resort etc). The final selected winner of grand prize, and guest(s), have until December 31, 2019 to travel. There is no blackout travel date for the period of prize validity. In case the winner cannot travel during the validity of the prize and/or cannot qualify for the necessary travel documentation, the prize will be voided. The winner will be responsible for any taxes, tips, insurance and expenses not explicitly stated as part of the prize.

Selection of Winners

• Potential winning entries will be generated using the campaigns database system (an electronic program managed by [Trend Media]), at the software developers’ location in South Africa. Entries will be randomly selected from the database containing the phone numbers, entry codes and dates of entry for which the text was submitted. These entries will be provided to Trend Media who will provide them to Berger Jamaica Limited to alert the winners. The draw will be done by 1 p.m. on each of the draw dates listed.
• For each draw date, after the first draw, only entries entered between the day of the previous draw date at 12:00 a.m. and the day before that draw date at 11:59 p.m. will be eligible to win. All entries entered during the promotional period will be eligible to win the Grand Prize.
• Two (2) entries per week will be electronically selected at random on each draw date as per schedule provided from the database. These winners will win one (1) Aiwa 40” SMART TV Dimension without stand: (LXWXH) each. An additional three (3) entries will then be selected to function as backup winners.
• a. The schedule for the fortnightly prize draws are November 21, 2018, December 5 and December 19, 2018 and January 3, 2019.
  b. The Grand Prize draw will be conducted on January 9, 2019.
• There will be eight fortnightly winners and one Grand Prize winner.
• There will be 26,500 winners of instant prizes.
• The winners will be notified by telephone within five days from the date of the draw. Three additional backup winners will be chosen. Contact will be attempted by telephone three times a day for the 3 day period. If the winner cannot be contacted by telephone within five days of the draw date, another winner will be selected from the backup winners (in the order the winners were selected). In the event that no winner can be found or a prize remains unclaimed, Berger Paint reserves the right to retain possession of the prizes.
• BERGER PAINTS and or its representatives reserve the right, with the Authorisation of the Betting, Gaming and Lotteries Commission, to examine identification and may choose to accept or deny awarding the prize based on the information presented.
• The Winners will be required to provide proof of their age and sign an Affidavit of Eligibility/Prize Acceptance and Release within five days of the notification to be confirmed as the winner. A Passport, Driver’s License or National ID will be the accepted forms of identification.
  
  If the winner declines to fulfil these conditions to collect the prize, their eligibility will be voided and another winner will be chosen from the pool of backup winners. The winners and their companions must be legally and physically able to travel, and must be able to qualify for the necessary travel documentation (Passport etc.). If the selected winner is unable to meet any of these criteria by the time the validity of the prize expires, their eligibility will be voided.
• If a Winner does not redeem the prize in the manner described above, BERGER PAINTS reserves the right, with the Authorisation of the Betting, Gaming and Lotteries Commission, in its sole and absolute discretion, to disqualify such winner and to select a replacement winner from the remaining qualifying preselected backup entrants. BERGER PAINTS shall not be responsible for failed attempts to redeem a prize and no responsibility is assumed by BERGER PAINTS for any problem(s) associated with attempt(s) to redeem a prize(s).
• Prizes cannot be transferred, assigned, or redeemed for cash. Unless otherwise set forth herein, winners of the fortnightly and grand prizes shall be solely responsible for any and all costs not specifically described as part of the prize. Winners of the grand prize will be solely responsible for all and any other related travel expenses.
• BERGER PAINTS is not responsible for any liabilities arising directly or indirectly from the award or use of the prizes.
• In claiming your prize, you acknowledge that BERGER PAINTS reserves the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner, across any advertising medium and for promotional purposes and without financial remuneration.
• Privacy / Use of Personal Information: BERGER PAINTS may gather Personal Information provided by entrants for the purposes of conducting and managing this contest and may, for this purpose, disclose such Personal Information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as may be required by regulatory authorities. Personal Information may include, but is not limited to: name (full name or first initial and last name), maiden name, email address, telephone number and physical address. This information is only collected when volunteered by an individual entering the contest. If the requested Personal Information is not provided, then an individual will not be able to participate in the contest. Each entrant gives permission to BERGER PAINTS to send promotional messages to them.
• Claims: Under no circumstances will entrants be permitted to seek the award of damages, and hereby waives all rights to claim, punitive, incidental and consequential damages or any other damages, and to have damages multiplied or otherwise increased. All entrants agree to submit to the exclusive jurisdiction of the BERGER PAINTS location governing their jurisdiction and agree to waive the right to a jury trial with respect to any claim or dispute with regard to any aspect of this promotion or official promotion rules.
