BERGER Colour Cash Promotion Rules

  • The name of the promotion is “Berger Colour Cash Promotion”
  • Entrants must be at least 18 years of age at the time of entry.
  • Promotion runs from July 1, 2019 to August 18, 2019.

How to Enter

  • Consumers must purchase a minimum of three (3) gallons of the eligible/featured Berger decorative paints at any authorized / participating paint dealers. Eligible products are Royale Emulsion Gloss and Satin, Weatherproof, 303, Everglow, 404, Rust Pro, Magicote Flat and Magicote Gloss, whether the purchase is in quarts, one gallon or 5-gallon pails.
  • Consumers will receive a Berger entry form from either an in-store Berger sales promoter or a store Supervisor.
  • Consumers must then fill out the Berger entry form with their full name, Address, telephone number and email address. Consumers must also include the date, outlet he/she purchased the paints from as well as the Invoice number from their purchase receipt (Proof of Purchase). Consumers must retain their proof of purchase receipt in order to claim a prize, if selected.
  • Consumers must then drop their completed entry forms in the wrapped “Berger Cash Colour promotion” box located at the outlet.
  • Winners must present proof of purchase, which includes a matching receipt number as that entered on entry form to claim prizes.
  • The promotion runs from July 1st, 2019 until 11:59 PM EST August 18th, 2019. BERGER PAINTS is not responsible for late, incomplete, misdirected entries or printing errors. All ineligible entries will be void. All entries become the property of the BERGER PAINTS.

The Prizes

  • GRAND PRIZE: All valid entries will compete to win the grand prize of:

    a. JMD$150,000.00 and
    b.A free paint makeover of any one room in their residential home. Paint labour and supervision to be supplied by Berger Paints and their agents.
  • BI-WEEKLY PRIZES: All valid entries will compete to win one of two cash prizes of JMD$50,000.00 every two weeks. There will be eight (8) winners in total. A total of JMD$400,000.00 to be awarded.
  • CONSOLATION PRIZES: Bi-Weekly, all valid entries will compete to win one (1) of five (5) Gift certificates redeemable for one (1) gallon of any Berger brand paint, to be collected at any Berger Office/ Factory outlet - Located in Kinston, Mandeville or Montego Bay. A total of twenty (20) individual gallons to be awarded, valued at JMD$80,000.00.
  • Non-cash prizes cannot be redeemed for cash or transferred to anyone.
  • The paint make over offer must be taken up within three months of winning the grand prize. Room selected must be contained within the confines of a residential home.
  • Participants must retain a copy of their receipt for proof of purchase in order to collect their prizes.
  • Participants must properly fill out the Berger entry form.
  • Participants are allowed to enter as many times as they wish to increase their chances of winning, however, only one prize will be awarded per person in each draw.

Selection of Winners

  • All drop boxes will be picked up every other week and replaced with a new one to facilitate the bi-weekly draws until the promotional period ends.
  • All boxes picked up will be taken to Berger Paints Head Office to execute the bi-weekly and grand prize draws.
  • Entries from all the outlets collected bi-weekly will be combined and thereafter, all draws will take place based on draw schedule below;

  • All bi-weekly entries will be carefully stored for the grand prize draws.
  • Two persons will be randomly selected from the pool of entries stored every other week (bi-weekly) to win JMD$50,000.000 each, until the promotion ends. These winning entry forms will be selected by hand
  • Five (5) persons will be randomly selected from the pool of entries stored every other week (bi-weekly) to win one (1) gallon each of a Berger branded paint, until the promotion ends. These winning entry forms will be selected by hand
  • The Grand Prize draw will be conducted on August 27, 2019at Berger Paints Jamaica Limited’s Head Office by 2:00 p.m.
  • There will be eight (8) fortnightly winners and one (1) Grand Prize winner.
  • There will be twenty (20) winners of one 1 gallon paint.
  • Prizes for bi-weekly will be drawn in the following order. The first randomly selected valid entry wins $50,000. The second randomly selected valid entry also wins $50,000. The following 5 randomly selected valid entries each win a consolation prize of a gallon of paint.
  • The winners will be notified by telephone within three days from the date of the draw. Three additional backup winners will be chosen. Contact will be attempted by telephone three times a day for the 3 day period. If the winner cannot be contacted by telephone within three days of the draw date, another winner will be selected from the back up winners in the order in which the back up entries were drawn. Consolation prize winners will not be moved up to $50,000 winners if the backup winners are exhausted. In the event that no winner can be found or a prize remains unclaimed, Berger Paint reserves the right to retain possession of the prizes.
  • The Winners will be required to provide proof of their age and sign an Affidavit of Eligibility/Prize Acceptance and Release within five days of the notification to be confirmed as the winner. A Voter’s I.D, Passport or Driver’s License will be the only accepted forms of identification.
  • BERGER PAINTS and or its representatives reserve the right, with the Authorisation of the Betting, Gaming and Lotteries Commission, to examine identification and may choose to accept or deny awarding the prize based on the information presented.
  • By entering this competition the winner agrees to allow Berger Paints Jamaica Limited to publicize your name, character, likeness, photograph, voice and the fact that you are the winner, across any advertising medium and for promotional purposes and without financial remuneration. Failure of potential winners to grant permission to publish their images will result in forfeiture of their prize winning.
  • If the winner declines to fulfil these conditions to collect the prize, their eligibility will be voided and another winner will be chosen from the pool of stored entries.
  • If a Winner does not redeem the prize in the manner described above, BERGER PAINTS reserves the right, with the Authorisation of the Betting, Gaming and Lotteries Commission, in its sole and absolute discretion, to disqualify such winner and to select a replacement winner from the remaining pool of stored entry forms. BERGER PAINTS shall not be responsible for failed attempts to redeem a prize and no responsibility is assumed by BERGER PAINTS for any problem(s) associated with attempt(s) to redeem a prize(s).
  • Employees of Berger Paints Jamaica Limited, M Squared Creative Studios Advertising Agency, Employees of the participating hardware stores and of The Betting, Gaming & Lotteries Commission as well as their immediate families (Spouses, Parents, Children, Siblings) are not eligible to enter this competition.
  • Privacy / Use of Personal Information: BERGER PAINTS may gather Personal Information provided by entrants for the purposes of conducting and managing this contest and may, for this purpose, disclose such Personal Information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as may be required by regulatory authorities. Personal Information may include, but is not limited to: name (full name or first initial and last name), maiden name, email address, telephone number and physical address. This information is only collected when volunteered by an individual entering the contest. If the requested Personal Information is not provided, then an individual will not be able to participate in the contest. Each entrant gives permission to BERGER PAINTS to send promotional messages to them.
  • Claims: Under no circumstances will entrants be permitted to seek the award of damages, and hereby waives all rights to claim, punitive, incidental and consequential damages or any other damages, and to have damages multiplied or otherwise increased. All entrants agree to submit to the exclusive jurisdiction of the BERGER PAINTS location governing their jurisdiction and agree to waive the right to a jury trial with respect to any claim or dispute with regard to any aspect of this promotion or official promotion rules.
